Parents choosing to proceed with tutoring services indicates an acceptance of these Terms of Service.  <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Services<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Tutoring services will be provided in accordance with best practice educational concepts and ethical standards.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-8f761849 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Tutoring is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Educational support<\/li>\n\n\n\n<li>An opportunity to help a student reach their best potential<\/li>\n\n\n\n<li>Help with work, academic skills, and learning approach<\/li>\n\n\n\n<li>Coaching with academics, organization, and approach to learning<\/li>\n\n\n\n<li>A cooperative relationship fostering a student&#8217;s growth<\/li>\n\n\n\n<li>A great opportunity for students looking to grow and parents looking for student support in reaching their best potential, when working together for student success.<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Tutoring is not:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Educational replacement<\/li>\n\n\n\n<li>An expectation that the student will exceed their capabilities<\/li>\n\n\n\n<li>Someone to do the work for the student to ensure a higher grade<\/li>\n\n\n\n<li>Going to &#8220;fix&#8221; everything academically, organizationally, or in learning<\/li>\n\n\n\n<li>A babysitting service to occupy a child or &#8220;make them&#8221; do their work<\/li>\n<\/ul>\n<\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Tutor responsibilities<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Tutors will support the student with methodology, techniques for successful completion of assignments, and reviewing content where the student needs practice or additional instructional support.  Tutors will cooperate with parents and teachers (when appropriate), using their own professional judgment, to provide educational support to help the student reach the goals established when initiating tutoring services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutors are responsible for providing lessons in accordance with best practice educational concepts and ethical standards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutors will provide encouragement to students, in a manner responsive to their growth and achievement, reinforcing a positive learning environment in the tutoring environment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Student responsibilities<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Tutoring services are not a guarantee of a grade, a substitute for student work, or an alternative to school\/classroom participation.  Students must give their best effort in the classroom, in tutoring sessions, and when completing their work.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Students must do their own work.  Cheating, including plagiarism and use of AI when student work is expected, are not tolerated.  While this is not an all encompassing definition of cheating, it is collectively understood that students are responsible for completing their own work, consistent with generally accepted academic principles.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Students are expected to track their own school assignments and to complete them on time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Students are encouraged to make notes of concepts where help is needed, to share with their tutor.  This facilitates an effective use of tutoring services.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Parent responsibilities<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Parents understand that hiring a tutor does not replace their role as a parent, engaged in their student&#8217;s education, and responsible for their student&#8217;s personal conduct.  Students are held to high standards, to include a firm &#8220;no-cheating&#8221; policy, consistent with the student&#8217;s capabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parents will provide encouragement to students, in a manner responsive to their growth and achievement, reinforcing a positive learning environment at home.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parents are to pickup children from tutoring sessions promptly, at times as agreed upon between the parent and tutor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parents are responsible for ensuring timely payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parents are responsible for school \/ teacher communication.  Tutor feedback may be provided to the parent as appropriate, but is not a replacement for the parents&#8217; communication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parents are encouraged to make notes of concepts where help is needed, to share with their student&#8217;s tutor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Billing<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">MrsAsTutoring.com will provide an invoice where required (NCSEAA ESA+ Program participants). Otherwise payment is considered due at time of service. There may be times where an agreement can be reached for payment of multiple sessions together, generally no more than 1 week&#8217;s services at a time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are no refunds on completed tutoring services.  Services are billed retrospectively, therefore having already been completed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If there is concern of an error in the billing amount, we are happy to review and discuss the discrepancy, and will reduce the bill to correct a confirmed error.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Accounting of Time<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Billable time is considered on fifteen (15) minute increments, billed as quarter (1\/4 or 0.25) hours.  Time will be rounded, where 8 minutes is rounded up and 7 minutes is rounded down.  Sessions started early may be ended equally early, with potential to extend as below.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Timely Payment<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Once services are provided, payment is expected no later than 10 days later. NCSEAA ESA+ Program participants are expected to submit their invoice through ClassWallet within 7 days to facilitate timely payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Late payment is subject to a 10% late fee.  This will compound every 30 days thereafter.  NCSEAA does not pay late fees, this will be the responsibility of the parents.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Refunds<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Billing concerns should be discussed with MrsAsTutoring.com by using the Contact Us page.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Should an error be identified on a bill that has already been paid, a refund will be offered, or a credit applied for future service, at the discretion of MrsAsTutoring.com. This will be on a case by case basis, and will be in compliance with any regulatory guidelines established by paying authorities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a refund is approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 10 days. Discounted services will be refunded at the amount paid, not at full price.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Late or missing refunds<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">If you haven\u2019t received a refund yet, first check your bank account again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then, contact your credit card company.  It may take some time before your refund is officially posted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Next, contact your bank.  There is often some processing time before a refund is posted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you\u2019ve done all of this and you still have not received your refund yet, please Contact Us using the link at the top of the website.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Rates and Rate changes<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Rates may change from time to time.  Billing will be conducted in accordance with the rates in effect at the time of service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MrsAsTutoring.com will notify the Parent of any rate increases with a minimum of 7 days notice before they take effect. Parents may elect to cancel any sessions or make schedule adjustments after the rate change.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Transportation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">From time to time, students may require transportation for tutoring services.  When the tutor and the parent agree to transportation provided by the tutor, acceptance of these terms of service also serves as legal written authorization for the tutor to transport the child\/student.  When transporting students, tutors will operate vehicles with due regard, and students will use all appropriate safety devices (seat belts).  However, there is no obligation for tutors to provide transportation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a convenience for the best interest of the student, and not an obligation of the tutor. Parents remain responsible for the wellbeing and locational awareness of their student. MrsAsTutoring.com does not provide a transportation service, we are not a for-hire transportation agency, and we are not bound to these obligations. Any transportation provided is a simple convenience for the parents, provided at the same level as a friend giving a ride to your child.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Medical Considerations<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Many students have special medical needs.  If a student is due for medication or specific care at a time when they are with the tutor, it is the parent&#8217;s responsibility to notify the tutor and provide the medication and\/or care supplies.  Likewise, the parent is responsible for any special medical instructions that must be provided to the tutor.  Tutors will do their best to meet these needs, but some special circumstances are beyond the scope of tutoring and may be declined by the tutor (ie. when private duty nursing is required).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutors are not responsible for toileting, diaper changing, or personal care.  However, if personal care is a component of the lessons being provided (ie in conjunction with classroom lessons on the topic), the tutor may engage the student in this from an educational perspective only.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">In School Services<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When applicable and allowed by the school, tutoring services may be provided in the school environment.  Parent authorizes Tutor to provide these services in the school setting, as well as authorizes the school to allow Tutor access to the Student during school hours.  This is still tutoring time, as considered in calculation of time as below and is billable to the parent, as above.  Tutor will work cooperatively with the school to minimize disruption and maximize services to the student.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cancelations and Time<\/h2>\n\n\n\n<h4 class=\"wp-block-heading\">Cancelations<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Cancelation notice is required 48 hours in advance.  In the event of unforeseen circumstances, an exception may be provided, but does not constitute blanket acceptance or a guarantee of future exception.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When canceling, notification is made directly to the tutor.  The tutor will acknowledge the cancelation, either by voice in a phone conversation, or by text message.  Without acknowledgement, understand that the tutor may not have received your message and follow up is the responsibility of the parent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cancelations with greater than 24 hours of notice, but less than 48 hours of notice will require 50% payment.  Cancelations with less than 24 hours of notice will require full payment.  When using a third-party payor (ie NCSEAA), canceled appointment fees may not be covered, and are still the responsibility of the parent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event that 4 or more sessions are canceled within a two (2) week period, including previously scheduled sessions at time of service termination, half (1\/2) of the fees that would have been collected will remain due.  Parents are expected to understand that tutors have made time commitments and are declining other students in order to commit to these student appointment, and cancelation, even by termination of services, results in damages to the tutor and to SheenasTutoring.com.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Lateness<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Arrival greater than 15 minutes after the scheduled start time of a tutoring session is considered a cancelation with less than 24 hours notice.  Should the tutor elect to proceed with tutoring when the student arrives late, regardless of how late, the billable time will begin with the originally scheduled appointment time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutors are not obligated to continue for the original scheduled appointment duration after a late arrival, but may elect to do so with agreement from the parent.  In this event, the time still begins with the original scheduled time, and will continue to the newly adjusted end time as agreed upon between the tutor and parent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a session was scheduled to end and the parent is late to pickup the student, the student and tutor may elect to continue until parent arrival.  This is billable time.  If this specific term is not desirable, parents may communicate in advance with the tutor that they should not continue beyond any scheduled end times.  Parents later than 5 minutes for a pickup time are responsible for half (1\/2) of the hourly rate for the session.  Parents later than 35 minutes for a pickup time are responsible for one (1) hour of the rate for the session.  Any additional lateness beyond 65 minutes is billable at 1 hour increments, beginning with the second hour at the 66th minute and the third hour at the 121st minute.  Parents who have not picked up their student after 1 hour, without communication and agreement of the tutor, will be considered to have abandoned their child, and the tutor will follow applicable reporting laws.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If advanced arrangements are made with the tutor for a later pickup, this will not apply unless discussed and agreed upon with the parent.  There is no obligation for the tutor to agree to a later pickup time, but there are times when the tutor will agree to a later pickup than the scheduled end of the tutoring session.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Grace is not binding<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">When MrsAsTutoring.com or the tutor extends grace with cancelations or appointment times, this is not a precedent for future cancelations or lateness. These terms of service are the binding expectation.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Cancelations or lateness of a tutor<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Because of the need to accommodate many students in many locations, transportation delays may occur from time to time.  If they are a consistent delay, services will be rescheduled going forward.  In the event of tutor lateness, the tutor will communicate as soon as they are aware that lateness will occur.  The parent can elect to continue with the session, the parent and tutor can elect to amend the appointment schedule for that session, or the parent can elect to cancel.  When this occurs and the parent elects to cancel, there is no penalty or charge.  Late time is not billable, however if the appointment time is amended this is billable.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mandated Reporting<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Tutors may or may not be mandated reporters under applicable laws. They are responsible for completing reports as obligated. This is mandated by law and is not excusable by MrsAsTutoring.com.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Completion of a mandated report is about caring for the student, and it is a sign of professional and ethical conduct. As such, it is not a termination of the tutoring agreement, and it is not an excuse for non-payment. Parents agree to hold tutors and MrsAsTutoring.com harmless for completion of any mandatory reporting requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, if a situation is untenable for the tutoring to continue, this may be grounds to stop tutoring services.  In this event, financial obligations persist for any previously performed services.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Limitations, Severability, and Disputes<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">MrsAsTutoring.com is based in Pamlico County, North Carolina, and all disputes will be settled under North Carolina law, with jurisdiction in Pamlico County. This is without regard to the location of any individual or series of tutoring sessions or the residence location of the student and\/or parent(s).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Should any segment, paragraph, or sentence be deemed inconsistent with law, unenforceable, or otherwise excluded from these terms of service, the remainder of this agreement will remain in effect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parents, Tutors, Students, and MrsAsTutoring.com are in agreement to proceed under these Terms of Service, as evidenced by initiation and participation in tutoring services. Parents have acknowledged acceptance of these terms of service when completing the registration process on the website, and are bound as such.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Termination<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Services are considered terminated upon written notification by a parent.  Any previously scheduled appointments at this time will be canceled, and any fees for cancelation will still apply based on the notice received.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MrsAsTutoring.com reserves the right to cancel services for any reason, without limitation or obligation to provide a reason for cancelation. When services are canceled by MrsAsTutoring.com, any outstanding billables remain due, all future appointments are canceled, and the relationship established by these terms of service are ended from that point forward but not excusing any responsibilities in effect at the time of the event.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutors may elect to end their tutoring relationship with the student. In this event, MrsAsTutoring.com may elect to arrange an alternate tutor or end the tutoring services. This will be at the sole discretion of MrsAsTutoring.com, and is based on the circumstances, scheduling requirements, availability of services, and needs of the student. In this event, Tutors will notify the parent directly of the end of their individual relationship.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MrsAsTutoring.com may elect to end the relationship between a specific tutor and student, without obligation to provide a reason. An alternate tutor may be provided, or the services may be terminated. Parents retain the right to accept or reject the alternate tutor, however rejection may result in service termination.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Exclusivity<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">MrsAsTutoring.com is not a free referral service. As such, any tutoring relationship initiated through MrsAsTutoring.com remains subject to fees, which may remain in effect even after termination of services originally through MrsAsTutoring.com.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event that a private relationship is established with a current or former MrsAsTutoring.com tutor, originally suggested by MrsAsTutoring.com or previously under service through MrsAsTutoring.com, the Parent will be responsible for payment to MrsAsTutoring.com equal to 50% of the service rate through MrsAsTutoring.com in effect during the time services are provided. This will remain in effect for a period of 180 days after termination of services through MrsAsTutoring.com. Should the tutor remain under agreement with MrsAsTutoring.com as a tutor, there will be no limitation of the period of this debt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is clear that Parents should not be establishing a relationship separately with a tutor to circumvent MrsAsTutoring.com, and should this occur, it is considered financially damaging to MrsAsTutoring.com. As such, the Parent accepts this liability.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Definitions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As included herein, the following definitions apply:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutor &#8211; Any person serving as a tutor of MrsAsTutoring.com. The responsibilities of a tutor are inclusive whether this is a contracted agent, employee, administrator, or owner of SheenasTutoring.com.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parent &#8211; This term is considered inclusive of one or more parents, step-parents, legal guardians, or others initiating tutoring services on behalf of the student.  Collectively, these parties or party initiating tutoring services accept responsibility for the requirements in this terms of service and assert their legal authority to enter into such an agreement on behalf of the student.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Student &#8211; The person receiving tutoring services, without regard to public or private school enrollment status.  While it is generally assumed that this will be a child, there may be times when the student is a legal adult.  In the event the student is a legal adult, they are expressing agreement with these terms of service by participating in tutoring services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MrsAsTutoring.com &#8211; A service entity, responsible for coordination of tutoring services, regardless of incorporation status vs sole proprietorship at time of any event under these terms of service.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Need help?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Contact us using the website for additional concerns.
